What is going on?
There is a document on the web from, it is said, secondary school No. 2 in Zhodzina. It asks parents for their consent to process their child's personal data. And not only that, writes telegraf.by.
The photo of the document shows that some Operator is going to process a list of information not only about the child (name, gender, citizenship, passport details, address, phone number, etc.), but about the parents as well.
In addition, users have stressed, this information may be passed on to "third parties" - it is written in the consent. It is not specified to whom.
The document states that the processing of personal data is necessary to:
to ensure the educational process;
participation in events (Olympiads, competitions, [...] photo and video recordings during events);
maintenance of statistics.
It is not known whether other Belarusian schools collect such consents.
Some Belarusians do not understand why schools should collect this personal data and why parents should agree - and are outraged. And some believe there is "nothing criminal" about it.
"On November 15, the Personal Data Protection Act came into force. The subjects are individuals. Processing requires written consent for certain purposes. Read the purpose of the processing. So... nothing "criminal". Third parties may be medical workers, for example, who have been given names and dates of birth," wrote one of the users of the Network.
Under Law No. 99-З of May 7, 2021 "On Protection of Personal Data", processing of personal data is to be carried out with the consent of the subject of personal data, except in cases prescribed by law. The consent of the personal data subject may be obtained in writing, in the form of an electronic document or in another electronic form. The processing of personal data is to be limited to the attainment of specific, predetermined legitimate purposes.
The law provides for the basic rights of personal data subjects, in particular the subject has the right to withdraw their consent at any time without giving reasons, to obtain information about the processing of personal data and about the provision of personal data to third parties, to change personal data, to request the termination of processing and deletion of personal data and to appeal against actions and decisions of the personal data controller to an authorised body.
